How Arizona Law Classifies Manslaughter Charges And Punishments

A person can be charged with manslaughter by “recklessly causing the death of another,” or “intentionally or knowingly committing murder in the heat of passion or upon a sudden quarrel,” according to state law. Because of the vagueness of the statute, there are many defenses to a manslaughter charge. This is why it is important to have an attorney begin crafting defenses as soon as possible.

Manslaughter is considered a class 2 felony. Under Arizona sentencing guidelines, the presumptive sentence for a class 2 felony (with no prior convictions) is five years in prison. If there are aggravating factors or a person has prior felony convictions, the sentence could be at least 12.5 years in prison.
