In an attempt to beat the miserable Arizona heat, many people, from in state to out of state, flock to Mesa to tube down the salt river. Maricopa County Sheriff’s Office (MSCO) and Mesa Police know that this is a hot spot and have made it their mission to bust anyone and everyone who are under 21 and have been drinking alcohol. The technical charges are called Minor in Consumption of Alcohol and Minor in Possession of Alcohol. These charges are often referred to as MIC and MIP.

I found it difficult to walk out of the river under these conditions. In fact, to someone who has never met me, it would have appeared that I was drunk. In my opinion as an attorney who handles more MIC and MIP cases that anyone other attorney in Arizona, the officers know that it is difficult to walk at the end of the river and use the conditions to support their phony police reports to show that my clients were exhibiting signs of impairment.
I have found that the smarter my client is about their constitutional rights, the more aggressive the police officers are. They don’t want people, much less people under 21, questioning their authority. If my clients refuse the portable breath tests, the officers threaten to arrest them and take them downtown where they house people arrested for felonies. THIS IS AN ABSOLUTE JOKE. The Mesa Police and MCSO are bullying young kids who are having a good time.
