Tempe DUI Case Reduced to Reckless! Don’t be Reckless by not Hiring a Lawyer!

This morning, I resolved a case where my client was originally charged with driving under the influence of alcohol, driving with a blood alcohol concentration greater than .08, and failing to drive in a single lane of traffic.  Here’s a breakdown of what happened:

Client was pulled over for drifting. When the officer made contact, he noticed my client had blood shot watery eyes, slurred speech, a strong odor or alcohol, and my client admitted to drinking vodka and cokes.The Tempe police officer asked my client to exit the vehicle and performed field sobriety tests.  According to the officer, my client failed all three tests.  Based on her performance she was arrested for DUI.  Because my client had a blood alcohol concentration greater than .08, she was served with a 90 day driver’s license suspension.  As I do in all my DUI cases, I requested an administrative hearing with the MVD to contest the DUI and license suspension.  I was successful at the hearing and had my client’s driver’s license suspension voided.  Bottom line – no suspension!!
